By accessing or using our services, including but not limited to solar panel installation, consultation, and related services (the "Services"), you ("you," "your," or "Customer") agree to be bound by these Terms.

1. Agreement to Terms

These Terms constitute a legally binding agreement between you and Clear Earth. If you do not agree to all of these Terms, do not use our Services or access our Website.

2. Services Provided

Clear Earth LLC offers solar energy solutions, which may include:

  • Consultation and system design

  • Solar panel and equipment supply

  • Installation services

  • Maintenance and support services

  • Other related services as agreed upon

The specific Services to be provided to you will be outlined in a separate agreement or proposal.

3. Customer Obligations

As a Customer, you agree to:

  • Provide accurate and complete information necessary for Clear Earth to perform the Services.

  • Grant Clear Earth and its authorized personnel access to your property as reasonably required to perform the Services.

  • Comply with all applicable laws, regulations, and permits related to the installation and operation of your solar energy system.

  • Maintain the installed solar energy system in accordance with any provided guidelines.

  • Pay all fees and charges associated with the Services as outlined in the applicable agreement.

4. Payment Terms

Payment terms for our Services will be detailed in the individual agreement or proposal provided to you. These terms may include:

  • Deposit requirements

  • Payment schedules

  • Accepted methods of payment

  • Late payment penalties

5. Warranties

Clear Earth may provide warranties on the equipment and installation services as specified in a separate warranty document. These warranties are subject to certain limitations and exclusions. Any third-party manufacturer warranties will be passed through to the Customer to the extent permissible.

6. Limitation of Liability

To the maximum extent permitted by applicable law, Clear Earth LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages (including, without limitation, loss of profits, data, use, goodwill, or other intangible losses) arising out of or relating to your use of our Services or these Terms, even if we have been advised of the possibility of such damages. Our total liability to you for any claim arising out of or relating to our Services or these Terms shall not exceed the total amount paid by you to Clear Earth for the specific Services in question.  

7. Indemnification

You agree to indemnify, defend, and hold harmless Clear Earth LLC and its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to your breach of these Terms, your misuse of the Services, or your violation of any applicable law or the rights of a third party.  

8. Intellectual Property

The Website and its original content, features, and functionality (including but not limited to text, graphics, logos, and software) are and will remain the exclusive property of Clear Earth LLC and its licensors. These are protected by copyright, trademark, and other laws.

9. Termination

We may terminate or suspend your access to our Services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. You may also terminate your agreement with us according to the terms outlined in your specific service agreement.  

10. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Kansas, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or our Services shall be subject to the exclusive jurisdiction of the state and federal courts located in Kansas.  

11. Changes to These Terms

Clear Earth LLC reserves the right to modify or revise these Terms at any time. We will notify you of any material changes by posting the updated Terms on our Website or through other reasonable means. Your continued use of our Services after the effective date of any changes constitutes your acceptance of the revised Terms.  

12. Entire Agreement

These Terms, together with any applicable service agreements or proposals, constitute the entire agreement between you and Clear Earth LLC regarding the Services and supersede all prior or contemporaneous communications and proposals, whether oral or written.
